All rights, including copyright, in this website are owned by or licensed to Arighi Bianchi. You may not modify, distribute or re-post anything on this website for any purpose.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Arighi Bianchi.

Accuracy of content
Arighi Bianchi has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. Ordering errors
You are able to correct errors on your order up to the point at which you click on ‘place order’ on the final page of our ordering process.
   
Delivery charges
Delivery charges vary depending on the type of products ordered, the service you select and the delivery address. For full details of our delivery charges please refer to our Delivery Services and Charges section.  In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Distance Selling Regulations and other legislation.  Similar rights may apply for some international deliveries.
   
Acknowledgment and acceptance of your order
PURCHASE OF PRODUCTS
1.0    Creating the Contract
1.1    You place an order on the website by selecting an item and following the instructions.
1.2    You will have an opportunity to check and correct any input error in your order up until you click the Submit Order button.
1.3    After you have submitted your order you will receive an order acknowledgement e-mail from us. Please note that this e-mail is an acknowledgement and not acceptance of your order.
1.4    If you are paying by credit card, we will authorize your debit or credit card payment.
1.5    Once payment has been authorised, and we have determined the availability of stock we will arrange for the delivery of the goods to you. Acceptance of your order and the creation of a legally binding contract between us will only occur when we send you a second e-mail which contains the details of how your goods will be delivered to you.
1.6    We reserve the right to decline all or part of any order for whatsoever reason and should this occur we will e-mail you with these details.
1.7    It is recommended that you retain all e-mails relating to your order and contract.
1.8    The details of your specific contract are filed by us. Should you want any information regarding your order you may contact us. (For details see the contact us page of the Website.)

2.0    Payment
2.1    If you have chosen to pay by card, once your order is received we will process the payment for your order by way of the credit or debit card details you have provided. In the event that there is insufficient stock to satisfy your order you will be informed as soon as possible. A refund will be processed through your chosen credit or debit card used for the payment of the order.
2.2    If your order contains any item with a lead time of more than 4 weeks and you have opted to pay a 25% deposit by card, the balance outstanding must be paid in full on the same card before final delivery is made. As part of the checkout process, you will be requested to confirm that you agree to this. A receipt for the balance payment will be posted to your billing address.  We do not operate a ‘cash on delivery’ system.
2.3    We will advise you if your payment details cannot be authorized for any reason we may then invite you to pay by another method.
2.4    All prices and charges on this website are quoted in UK pounds. The price you pay for your order is that price which is displayed on the website. Prices include VAT unless otherwise stated but exclude delivery charges. Delivery charges are calculated as part of the checkout process, based on the proximity of your delivery address to us. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you an option of reconfirming your order at the correct price, or cancelling the order. If we are unable to contact you we will treat the order as cancelled and you will receive a full refund.

3.0    Security and Clearing
3.1    All credit and debit card payments that are made on our website are protected by a secure connection. This secure connection ensures that your credit and debit card is encrypted prior to it being transferred to the bank for authorization.
3.2    As an additional security means, no credit or debit card details submitted online are stored directly by us once your order has been processed.
3.3    If you have authorised us to obtain a second or final payment of your order on your chosen card, we will use the same secure connection to request these monies to be transferred to the bank for authorization. Your CV2 number is not retained by our Secure Payment Provider (SSP).

4.0    Delays
Occasionally, the manufacture of your furniture may be delayed. This can be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed.

5.0
    Damaged or Defective Goods
Every effort will be made to ensure that the goods you have ordered arrive undamaged and without defect.
If the goods are found to be either damaged or defective in any way at the time of delivery, you must complete an incident form immediately, which will be provided by the home delivery team. If damage is discovered after delivery, you must contact us within 3 days of delivery of the goods.

If the goods are damaged, and we are unable to repair the item to reasonably satisfactory manufacturing standards, we will send a replacement item upon confirmation that the damaged item has been returned to us.

If the goods are found to be defective we will refund all monies paid by you for the goods in question (including the delivery charges) together with any return delivery charges you may have reasonably incurred if you have undertaken to return the items yourself, in the same form of payment originally used for the purchase as soon as possible.

6.0    Cancellation right
Under the Distance Selling Regulations, UK consumers have the legal right to cancel their order within seven working days of receipt of the goods (with the exception of flower and plant gifts, made to order items including made to order curtains and cushions, Made to Measure shirts, fresh hampers, Artisan Chocolates and any other items as permitted under local law where applicable). Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered.

7.0    Cancellation by Us
7.1    We reserve the right not to accept any order request if:
7.1.1    We have insufficient stock to deliver the goods you have ordered;
7.1.2    We do not deliver to your area;
7.1.3    One or more of the goods ordered was incorrectly described or priced on the website;
7.1.4    The payment transaction is not authorized; or
7.2     If we do cancel your contract we will notify you by e-mail and will refund to you any sum paid by you to us in respect of the contract as soon as possible, and in any event within 30 days of the cancellation of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

8.0    Links to other websites
We have placed links on this website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. Arighi Bianchi cannot accept any liability in respect of the use of these websites.
   
9.0    Exclusions of liability
Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of  Arighi Bianchi or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions

    Changes to legal notices
We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.
•    Use of this website from outside the UK. Unless otherwise specified, the materials on this website are displayed solely for the purposes of promoting Arighi Bianchi 's products and services available in the UK. However Arighi Bianchi may accept orders for delivery to locations outside of the UK subject to customs, legal, regulatory and certain practical restrictions.  Those who choose to access this site from locations outside the UK or place orders for delivery to locations outside the UK are responsible for compliance with local laws if and to the extent local laws are applicable.
•    Our Terms & Conditions
•    CHRISTMAS - We will be busy! The closer we are to Christmas, the more likely it is that we will be able to offer you just one delivery date before Christmas - you will need to accept this date if you want your furniture for Christmas.  Should you not require your order until after the Christmas/New Year period, please inform our sales staff.  We will be happy to delay your delivery until post New Year.
•    Will it fit? Please remember to make a note of your furniture’s dimensions and check that it’ll fit into your house and into your chosen room.

12.0    Payment
Currently, all card transactions will be processed when your complete order has been received by our home delivery service.

13.0
    Delivery
All furniture orders are delivered within the UK mainland and Northern Ireland by our home delivery service
Each vehicle has a trained crew of two men, who carry identification cards at all times.

14.0
    Delivery arrangements for furniture
When your order is ready, our home delivery service will contact you to confirm your delivery date and a four hour timescale, e.g. 10 am to 2 pm. Your delivery won’t happen until you’ve been contacted by phone or by letter and you have accepted the delivery offered.

To help you plan your day, at the time of booking, you can ask the crew to contact you up to an hour before expected delivery. On the delivery day the crew will contact you to inform of any delay.

If you are unable to accept the delivery offered or you wish us to hold your order for a period of time, we can provide a storage service at a cost of £25 per week.

15.0    On delivery
Before our crew arrive, please ensure that normal ground floor access and the room itself have enough space for your new furniture to be delivered, our crew will unpack and assemble your furniture. All packing materials will be taken away, disposed of and recycled where possible. To make sure you’re completely satisfied the crew will ask you to inspect your items carefully and will give you a checklist to help you do this. After this, you’ll be asked to sign for the furniture. It’s therefore essential that you’re present. If you’re not satisfied for any reason, please inform the crew.

Furniture to Go items and delivery only furniture will be delivered to your door and left packaged. Some products may require self-assembly (instructions will be provided). A signature on receipt will be required.

NB Bed disposal service - the product(s) will not be removed if infested, wet or heavily soiled.  Products must be dis-assembled prior to collection.

16.0    Delays
Occasionally, the delivery of your furniture may be delayed or postponed. We will, or course, make every effort to keep you informed and discuss revised delivery timescales.

17.0    After delivery
Your furniture is manufactured to the highest standards. Look after it according to the care instructions and it’ll give you good service. should you have any issues, we have a dedicated customer service team who can be contacted on 01625 613333.
(In all cases you will be dealt with in accordance with your legal rights).

18.0    Stock Levels
As far as reasonably possible all products featured to buy on the website are either in stock and available at the time of ordering, or are produced to order with the anticipated lead-time published on site

If any item is out of stock we will notify you and proceed in terms of  a refund either by refund to the credit card you made the payment on.

19.0    Unforeseen Circumstances
While every effort is made to meet our customers’ demands, cancellations or variations may be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood, drought, or other causes beyond our reasonable control.

20.0    Complaints and Remarks
If you have a complaint or a particular remark to make please do not hesitate to contact us immediately by facsimile, telephone or e-mail, the details of which are contained under the “Contact Us” page.

Any complaint will be dealt with fairly, effectively and confidentially. Your statutory rights as a consumer are unaffected.

21.0    Contractual Capacity
In order to be eligible to enter into a contract with us to purchase goods through the website you must:-
provide the required information including your real name, payment details including your card address; your delivery address if different from your card address; e-mail address and telephone number; and be over the age of 18.

22.0    Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected.

23.0    Law
These terms and conditions shall be governed by and construed in accordance with English law and you hereby agree to be subject to the jurisdiction of the Courts of England and Wales. All contracts are concluded in English.

24.0    Data Protection and Privacy
Information you provide to us remains confidential. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998. We collect information about you for two reasons: firstly, to process your order and, secondly, to provide you with the best possible service. You specifically authorise us to transmit information to or to obtain information about you from third parties (including, but not limited to, your debit or credit card number), to authenticate your identity, to validate your debit or credit card and to authorise the transaction. These terms and conditions together with our current website prices, delivery details, contact details and Privacy Policy set out the whole of our agreement relating to the supply of goods to you by us.

Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us.  Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

The information contained in this Website may contain technical inaccuracies or typographical errors. All liability of Arighi Bianchi howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
